1. Scope and Acceptance
1.1 Parties
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Interactive Foundry AG, a company registered in Switzerland (CHE-402.037.884), with its registered office at Zentrum Staldenbach 9, 8808 Pfäffikon SZ ("we", "us", "Company").
1.2 Acceptance
By accessing or using JobsMatch ("Service"), including the websites jobsmatch.ch and jobsmatch.me, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.
1.3 Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Service. By using the Service, you represent and warrant that you meet these requirements.
2. Description of Service
2.1 What We Provide
JobsMatch is an AI-powered job matching platform that analyzes your CV and career profile to identify suitable job opportunities in the Swiss labour market. The Service includes CV analysis and parsing, automated job matching and recommendations, job alerts and notifications, and career-related tools and insights.
Employer Matching (optional): Employers may search for candidates matching their job requirements. If your profile is identified as a potential match, you will receive a notification. Your data is only shared with the employer if you provide explicit consent.
2.2 What We Do NOT Provide
JobsMatch is not an employment agency, recruitment service, or staffing firm. We do not guarantee employment, interviews, or any specific job outcomes. We provide technology tools to assist your job search; decisions about hiring are made solely by employers.
2.3 AI Technology Disclosure
Our Service uses artificial intelligence, including large language models and machine learning algorithms, to analyze CVs and match users with jobs. AI-generated outputs may contain errors or inaccuracies. You should always verify information and use your own judgment when making career decisions.
3. User Accounts
3.1 Account Registration
To use certain features of our Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials secure and confidential.
- Notify us immediately of any unauthorized access to your account.
- Maintain only one account per person.
3.2 Account Responsibility
You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
4. User Obligations and Acceptable Use
4.1 Permitted Uses
You may use the Service for legitimate job searching and career development purposes. You must comply with all applicable laws and regulations.
4.2 Prohibited Conduct
You agree NOT to:
- Upload false, misleading, fraudulent, or inaccurate information.
- Use the Service to spam, harass, or harm others.
- Attempt to reverse engineer, hack, or gain unauthorized access to our systems.
- Share your account credentials with others or operate multiple accounts.
- Use automated tools, bots, or scrapers to access our Service.
- Upload viruses, malware, or other harmful content.
- Violate any applicable laws, regulations, or third-party rights.
- Use the Service for any purpose other than personal job seeking.
4.3 Content Standards
All content you upload, including CV data and profile information, must be:
- Truthful and accurate.
- Related to legitimate professional qualifications and experience.
- Not infringing on any third-party intellectual property or privacy rights.
- Not containing discriminatory, offensive, or illegal content.
5. Intellectual Property
5.1 Our Intellectual Property
The Service, including its technology, algorithms, software, design, trademarks, logos, and content created by us, is the exclusive property of Interactive Foundry AG or its licensors. You may not copy, modify, distribute, sell, or create derivative works based on our intellectual property without our prior written consent.
5.2 Your Content
You retain ownership of the content you upload (CV, profile data, etc.). By uploading content, you grant us a limited, non-exclusive, royalty-free license to use, process, and analyze your content solely for the purpose of providing and improving our Service. This license terminates when you delete your account or request data deletion.
5.3 Aggregated Data
We may use anonymized, aggregated data derived from your use of the Service for statistical analysis, research, and service improvements. Such data cannot identify you individually.
6. Payment Terms
6.1 Free Services
We currently offer our core matching features at no cost during our beta period. Free services may have usage limitations. We reserve the right to modify, limit, or discontinue free features at any time with reasonable notice.
6.2 Paid Subscriptions (Future)
When paid subscriptions become available, the following terms will apply:
- All prices will be displayed in Swiss Francs (CHF) and include applicable VAT.
- Subscription fees are charged in advance for the subscription period.
- Subscriptions automatically renew unless cancelled before the renewal date.
- You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
- Refunds are not provided except as required by applicable law.
6.3 Price Changes
We may change subscription prices with at least 30 days' advance notice. Price changes will apply to the next billing cycle after the notice period.
7. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
8. Service Availability and Modifications
8.1 Availability
We strive to provide reliable access to our Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
8.2 Modifications
We reserve the right to modify, update, or discontinue any aspect of the Service at any time. For material changes affecting your rights, we will provide reasonable advance notice. Continued use of the Service after modifications constitutes acceptance of the changes.
9. Third-Party Services and Content
9.1 Job Listings
Our Service aggregates job listings from third-party sources (job boards, company websites). We are not responsible for the accuracy, completeness, or availability of third-party job postings. Your interactions with employers are solely between you and the employer.
9.2 External Links
Our Service may contain links to third-party websites. We are not responsible for the content, practices, or privacy policies of third-party sites. Accessing external links is at your own risk.
10. Disclaimers and Limitation of Liability
10.1 Service Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We specifically disclaim any warranty that the Service will meet your requirements, be uninterrupted or error-free, or produce accurate results. We do not guarantee job placement, interviews, or any employment outcomes.
10.2 AI Disclaimer
Our AI-powered features, including CV analysis and job matching, may produce inaccurate, incomplete, or unsuitable results. You are solely responsible for verifying AI-generated information and making your own career decisions. We are not liable for any decisions you make based on AI outputs.
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY SWISS LAW:
Our total liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) CHF 100.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, regardless of whether we were advised of the possibility of such damages.
10.4 Exceptions
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under Swiss law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Interactive Foundry AG, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Content you upload to the Service.
12. Termination
12.1 Termination by You
You may terminate your account and/or relationship with us at any time by contacting us at contact@jobsmatch.me or through your account settings. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
12.2 Termination by Us
We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent, illegal, or abusive activity, fail to pay applicable fees, or for any other reason at our reasonable discretion. Upon termination for cause, you may lose access to your data.
12.3 Survival
Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms and any disputes arising from or relating to them or the Service shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
13.2 Dispute Resolution
Informal Resolution: Before initiating formal proceedings, you agree to contact us at contact@jobsmatch.me to attempt to resolve any dispute informally within 30 days.
Jurisdiction: If informal resolution is unsuccessful, any disputes shall be submitted to the exclusive jurisdiction of the ordinary courts of the Canton of Schwyz, Switzerland, subject to any mandatory statutory provisions regarding jurisdiction.
Consumer Rights: If you are a consumer (as defined under Swiss or EU law), you may also have the right to bring proceedings in the courts of your country of residence.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
We may assign or transfer our rights and obligations under these Terms to a successor company in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.
14.5 Language
These Terms are provided in English. In case of any discrepancy between the English version and any translation, the English version shall prevail.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by email. The "Last Updated" date at the top indicates when the Terms were last revised. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
